These Terms of Use govern access to and use of the HomeMedian website, applications, tools, estimates, content, and services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms of Use.

These are HomeMedian’s general terms. They are separate from the VOW Terms of Use, which govern access to and use of protected VOW content. Please review both documents where they apply.

1. Eligibility and acceptable use

You may use the Services only if you are legally capable of entering into a binding agreement and your use complies with applicable law. If you use the Services on behalf of another person or organization, you represent that you have authority to accept these Terms on its behalf.

You agree to use the Services only for lawful purposes and in a way that does not interfere with the operation, security, availability, or integrity of the Services or impair another person’s use of them.

HomeMedian may restrict or suspend access where reasonably necessary to protect the Services, users, listing data, or the rights of HomeMedian or others.

2. Separate VOW Terms of Use

HomeMedian may provide access to protected VOW content through the Services. Access to and use of that protected content is governed by the separate VOW Terms of Use.

The VOW Terms of Use are a separate document and are not reproduced, replaced, summarized, or modified by these Terms of Use. If there is a conflict between these Terms and the VOW Terms of Use concerning protected VOW access or VOW listing information, the VOW Terms of Use govern that subject.

3. Services and listing content

The Services may contain property information, listing information, photographs, maps, market information, links, descriptions, and other material supplied by HomeMedian, its brokerage partners, data providers, listing services, or other third parties (collectively, “Listing Content”).

Listing Content is provided for general informational purposes. It may be incomplete, delayed, changed, or subject to data-provider restrictions. HomeMedian does not guarantee that Listing Content is accurate, complete, current, suitable for a particular purpose, or available at all times.

You should independently verify material information with the applicable brokerage, listing representative, or other qualified professional before relying on it or making a purchase, sale, financing, insurance, tenancy, or other real-estate decision.

Nothing on the Services is an offer, acceptance, representation, warranty, or commitment to sell, purchase, lease, finance, or insure any property. Availability, status, price, measurements, features, taxes, and other property details may change without notice.

4. Home-value estimates and AVM information

The Services may provide automated valuation model results, home-value estimates, market indicators, comparative information, or similar analytical content (collectively, “Estimates”).

Estimates are informational only. They are not appraisals, formal valuations, financial advice, tax advice, lending advice, brokerage advice, or a guarantee of a property’s value, sale price, rental value, market time, or future performance. An Estimate may not reflect the condition, improvements, defects, location factors, market conditions, or other characteristics of a property.

Do not rely on an Estimate as a substitute for an appraisal, inspection, market analysis, legal advice, tax advice, mortgage advice, or advice from a qualified real-estate professional. HomeMedian is not responsible for decisions made solely or primarily on the basis of an Estimate.

5. User submissions and communications

If you submit information, feedback, questions, requests, photographs, reviews, or other material through the Services (“User Content”), you represent that you have the right to submit it and that it does not violate applicable law or another person’s rights.

You grant HomeMedian a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and use User Content as reasonably necessary to operate, maintain, improve, and provide the Services and respond to your request. HomeMedian may remove User Content that it reasonably believes is unlawful, misleading, harmful, or inconsistent with the Services.

Do not submit confidential, sensitive, or unnecessary personal information through a public-facing feature. Personal information is handled as described in the Privacy Policy.

6. Intellectual property

The Services and their original content, design, software, branding, logos, text, graphics, interfaces, compilations, and other materials are owned by or licensed to HomeMedian and are protected by applicable intellectual-property laws.

Subject to these Terms, HomeMedian grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for their intended personal or internal business purpose. No ownership rights are transferred to you.

You may not copy, modify, publish, sell, license, distribute, reverse engineer, create derivative works from, or exploit HomeMedian’s proprietary materials except with prior written permission or as expressly permitted by law. This section does not grant permission to use protected VOW content; that content is governed by the separate VOW Terms of Use.

Third-party names, marks, listing data, photographs, and other materials remain the property of their respective owners and may be subject to additional terms.

7. Privacy

Your use of the Services is also subject to the Privacy Policy, which explains how HomeMedian collects, uses, stores, and discloses personal information.

8. Third-party services and links

The Services may contain links to third-party websites, services, tools, or resources. HomeMedian does not control or endorse third-party content and is not responsible for its availability, accuracy, security, privacy practices, or terms. Your use of a third-party service is governed by that provider’s terms and policies.

9. Availability and changes

HomeMedian may modify, suspend, withdraw, or discontinue any part of the Services, content, feature, or functionality at any time. HomeMedian may also update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date.

Your continued use of the Services after updated Terms are posted means that you accept the updated Terms, to the extent permitted by applicable law.

10. Disclaimers

To the fullest extent permitted by applicable law, the Services and all content are provided on an “as is” and “as available” basis, without warranties or conditions of any kind, express or implied. HomeMedian disclaims warranties and conditions relating to accuracy, completeness, availability, merchantability, fitness for a particular purpose, title, non-infringement, security, and freedom from errors, viruses, or harmful components.

HomeMedian does not warrant that the Services will be uninterrupted, secure, error-free, or suitable for your needs, or that defects will be corrected. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

11. Limitation of liability

To the fullest extent permitted by applicable law, HomeMedian and its owners, affiliates, officers, directors, employees, agents, licensors, service providers, and data providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive loss or damage, or for loss of profits, revenue, opportunity, data, goodwill, or anticipated savings, arising out of or related to the Services or these Terms.

To the fullest extent permitted by applicable law, the total liability of HomeMedian and those persons for claims arising out of or related to the Services or these Terms will not exceed the greater of the amount you paid to HomeMedian for the Services giving rise to the claim during the six months before the event giving rise to the claim or CAD $100.

These limitations apply regardless of the legal theory and even if HomeMedian was advised that the loss or damage was possible. They do not limit liability that cannot lawfully be limited or excluded.

12. Indemnity

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless HomeMedian and its owners, affiliates, officers, directors, employees, agents, licensors, service providers, and data providers from claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Services, User Content, or violation of another person’s rights or applicable law.

13. Enforcement and termination

HomeMedian may investigate suspected misuse and may limit, suspend, or terminate your access to all or part of the Services if you breach these Terms, create risk or potential legal exposure, interfere with the Services, or where otherwise reasonably necessary to protect HomeMedian, its users, or third parties.

You may stop using the Services at any time. Provisions that by their nature should survive termination—including intellectual property, disclaimers, limitation of liability, indemnity, governing law, and general legal provisions—will survive.

14. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada, without regard to conflict-of-law principles. Subject to any mandatory rights or remedies available under applicable law, the courts located in Ontario will have jurisdiction over disputes arising from or relating to these Terms or the Services.

15. General terms

If any provision of these Terms is found to be invalid or unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in effect.

These Terms, together with the documents expressly incorporated by reference, are the entire agreement between you and HomeMedian concerning the Services and supersede prior statements about the same subject. HomeMedian’s failure to enforce a provision is not a waiver of its right to enforce it later.

You may not assign or transfer your rights or obligations under these Terms without HomeMedian’s prior written consent. HomeMedian may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or operation of the Services.

16. Language

These Terms are provided in English. If a translated version is made available for convenience and there is a conflict, the English version governs to the extent permitted by law.
