This Privacy & Security Policy describes how Richland Realty Inc. ("Richland Realty", "we", "us") collects, uses, discloses, and protects personal information when you use the HomeMedian website, mobile applications, and related services (collectively, the "Services"). We comply with the Personal Information Protection and Electronic Documents Act (Canada) ("PIPEDA") and other applicable Canadian privacy laws.
By using the Services, you consent to the collection, use, and disclosure of your personal information as described in this Policy.
1. Information We Collect
Information you provide:
- Account registration details: name, email address, phone number, and password
- Preferences you set, such as saved searches, saved properties, and notification settings
- Communications you send us, including feedback, support requests, and inquiries about properties
- Information you provide when requesting real estate services, such as buying, selling, or leasing intentions
Information collected automatically:
- Usage activity on the Services, such as properties viewed, searches performed, and features used
- Device and technical information: IP address, browser type, operating system, device identifiers, and app version
- Approximate location derived from your IP address, and precise location only if you grant permission in your device settings (used for map and nearby-property features)
- Cookies and similar technologies, described in Section 6
We do not knowingly collect personal information from individuals under 18. If you believe a minor has provided us personal information, contact us and we will delete it.
2. How We Use Your Information
We use personal information to:
- Create and manage your account and authenticate access to registered features
- Provide the Services, including property search, market data, saved searches, alerts, and estimated sale prices
- Respond to your inquiries and provide real estate brokerage services you request
- Send you service communications (account notices, alerts you subscribed to, policy updates)
- Send you marketing communications where you have consented, in accordance with Canada's Anti-Spam Legislation (CASL); you may unsubscribe at any time using the link in each message
- Maintain the security of the Services, prevent unauthorized access and misuse, and maintain audit records required under our data licence agreements
- Analyze usage in aggregate to improve the Services
- Comply with legal and regulatory obligations, including those under the Trust in Real Estate Services Act, 2002 (Ontario)
3. Disclosure of Your Information
We do not sell or rent your personal information. We may disclose personal information only:
- To real estate boards and data providers — you acknowledge that your registration information and activity records may be disclosed to PropTx Innovations Inc., the Toronto Regional Real Estate Board, and other real estate boards or their service providers for auditing, compliance, and legal purposes in connection with our data licence agreements
- To service providers who process data on our behalf (such as hosting, analytics, and email delivery providers), bound by contractual confidentiality and security obligations
- To fulfill your request — for example, to a real estate professional, lawyer, or lender you ask us to connect you with
- For legal reasons — where required by law, court order, or regulatory authority (including the Real Estate Council of Ontario), or to protect our rights, users, or the public
- In a business transaction — in connection with a merger, acquisition, financing, or sale of assets, subject to confidentiality protections
Some service providers may store or process data outside Canada. Where they do, your information may be subject to the laws of those jurisdictions. We require comparable protection through contractual safeguards.
4. Your Choices and Rights
You may at any time, by contacting us at info@richlandrealty.ca:
- Request access to the personal information we hold about you
- Request correction of inaccurate or incomplete information
- Request deletion of your account and personal information, subject to records we must retain for legal, audit, or compliance purposes
- Withdraw consent to marketing communications (you may also use the unsubscribe link in any marketing email)
- Raise a question or concern about our handling of your information
We will respond to access requests within the timelines required by PIPEDA. Note that deleting your account will end your access to registered features of the Services.
5. Retention
We retain personal information only as long as needed for the purposes described in this Policy, to comply with our legal and contractual obligations (including audit-trail requirements under our data licence agreements), and to resolve disputes. When no longer required, information is securely deleted or anonymized.
6. Cookies and Analytics
We use cookies and similar technologies to keep you signed in, remember preferences (such as language selection), and understand how the Services are used. We may use third-party analytics tools that collect usage data on our behalf. You can control cookies through your browser settings; disabling cookies may limit some features, including registered access.
7. Security
We take reasonable technical, physical, and administrative measures to protect personal information, including:
- Encryption of data in transit (HTTPS/TLS) — you can verify this by the lock icon and "https" in your browser's address bar
- Encrypted storage of passwords and access controls limiting personal information to personnel who require it to perform their duties
- Secure hosting environments, monitoring, and audit logging
No method of transmission or storage is completely secure. If we become aware of a breach of security safeguards involving your personal information that creates a real risk of significant harm, we will notify you and report to the Privacy Commissioner of Canada as required by PIPEDA.
8. Language
The Services are offered in English and Chinese. This Policy is prepared in English; a Chinese translation may be provided for convenience. In the event of any inconsistency, the English version governs.
9. Changes to This Policy
We may update this Policy from time to time. We will post the updated version with a revised "Last updated" date, and where changes are material, we will provide notice through the Services or by email. Your continued use of the Services after changes take effect constitutes acceptance of the updated Policy.
